Officially, they are. They are not the same classifications, but one is within another. A dinosaur is, officially speaking, any species that belongs to the Dinosauria clade. Saurischia is the only extant order of dinosaurs, then there's Theropoda > Neotheropoda > Averostra Tetanura > Orionides > Avetheropoda > Coelurosauria > Maniraptoriformes > Maniraptora > Pennaraptora > Paraves > Avialae > Euavialae > Avebrevicauda > Pygostylia > Ornithothoraces > Euornithes > Ornithurae > Neornithes. Neornithes are modern birds, and since they are within the Dinosauria we cannot say dinosaurs are extinct. Fossil evidence backs this up (Brown, J.W. & Van Tuinen, M., 2011. "Evolving Perceptions on the Antiquity of the Modern Avian Tree, in Living Dinosaurs". The Evolutionary History of Modern Birds (John Wiley & Sons LtD): 306–324.).
Dinosaurs are given as extinct, but this refers only to non-avian dinosaurs.

Funny how fast things change. Now spino is bipedal again. More likely suits the name theropod (beast legs or somethin'). The reconstruction was debunked by the public. 1. It whould need such claws if it was a quadruped. 2. It whould have bulkier legs and arms and will look like a hadrosaur probably. 3. All of it's relatives are bipedal. 4. The leg's proportions are just not suiting this body, it whould be unable to swim with them too because they won't create any push. 5. The legs were not found alongside the original fossil, a man gave them to Ibrahim claiming to had them for a long time. 6. Spino could swim with long legs too, just like sea birds, because theropod feet are way more flexible than human feet. 7. The theory of it being front heavy and that's why it's 4 legged is ruining itself. If it's frontheavy it will break it's arms, so It will probably walk like any other theropod to not do that -_- 8. If it is quadruped it will resamble ambulocetus which was slow in water and still evolving. Bassically it will be too slow in water and will sink. If it has bigger legs it will probably be faster.
